Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CameraNewVision mobile applications, web applications, websites, and related services (collectively, the "Services").

These Terms describe the conditions under which CameraNewVision provides its applications and services, including real‑time guidance from volunteers using your device’s camera, microphone and network connection. They complement any mandatory rights you have under applicable law and do not reduce those rights.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity, and "you" refers to that entity.

2. Eligibility

You may use the Services only if you (a) are legally capable of forming a binding contract with us under applicable law, and (b) are not prohibited from using the Services under any applicable laws.

If the Services are used by or on behalf of a minor, you are responsible for complying with any consent or age‑related requirements that apply in your jurisdiction.

3. Accounts and Security

Some features of the Services may require you to create an account. You agree to provide accurate and complete information when creating an account and to keep that information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use or suspected unauthorized use of your account.

4. Use of the Services

Subject to your compliance with these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your own personal, non‑commercial purposes. This includes installing and using the CameraNewVision mobile app, creating an account, placing calls to volunteers and, if you register as a volunteer, receiving and answering such calls.

We may introduce different plans, features, or usage limits for different tiers of access. Any additional terms that apply to a specific feature or plan will form part of these Terms.

5. User Content

The Services may enable you to capture, upload, store, or otherwise provide images, video, audio, or other content ("User Content"). You retain ownership of your User Content.

By providing User Content through the Services, you grant us a limited, non‑exclusive, worldwide, royalty‑free license to host, process, transmit, display, and use that User Content solely as necessary to provide, maintain, and improve the Services and as otherwise described in the Privacy Policy.

You are responsible for the legality, reliability, and appropriate use of your User Content, including obtaining all consents and permissions required under applicable laws.

6. Prohibited Conduct

You agree not to do any of the following while using the Services:

  • Use the Services for any unlawful purpose or in violation of any applicable law, regulation, or court order.
  • Capture or process content that infringes, misappropriates, or violates any third‑party rights, including privacy, publicity, and intellectual property rights.
  • Attempt to gain unauthorized access to the Services or related systems, or interfere with or disrupt their integrity or performance.
  • Reverse engineer, decompile, or attempt to discover the source code, except to the extent such restrictions are prohibited by law.
  • Use any automated means (including robots, spiders, or crawlers) to access the Services except as permitted by us in writing.

7. Intellectual Property

We and our licensors own all rights, title, and interest in and to the Services, including but not limited to software, interfaces, designs, text, graphics, and other content made available through the Services, excluding User Content.

Except for the limited license expressly granted to you in these Terms, no rights are granted to you under any intellectual property or proprietary rights, whether by implication or otherwise.

8. Third‑Party Services

The Services may integrate with or link to third‑party services, software, or content. We do not control and are not responsible for such third‑party offerings. Your use of them may be subject to additional terms and privacy notices provided by those third parties.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

We do not warrant that the Services will be uninterrupted, secure, or error‑free, or that any defects will be corrected. In particular, we cannot guarantee the availability of volunteers, the quality of any network connection, or the accuracy of information provided during a call.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of or inability to use the Services.

Our aggregate liability for all claims relating to the Services will be limited to the amount you have paid to use the Services (if any) during the twelve (12) months preceding the event giving rise to the claim, or a lower amount if required by applicable law.

11. Indemnification

You agree to indemnify and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

12. Suspension and Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe that you have violated these Terms, pose a risk to the Services or other users, or if we are required to do so by law.

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will continue to apply, including ownership provisions, warranty disclaimers, limitations of liability, and indemnity.

13. Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes to these Terms, we will provide notice in a way that we consider appropriate (for example, via the Services or by email, where permitted).

Your continued use of the Services after any changes become effective will constitute your acceptance of the updated Terms.

14. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of the country or region where CameraNewVision is established, unless different mandatory laws apply in your country of residence. Where permitted, disputes will be subject to the non‑exclusive jurisdiction of the courts of that country or region.
